COPPA Compliance Policy

Appcharge adheres to the Children’s Online Privacy Protection Act (COPPA) and the management of users whose ages meet or exceed the legal age of majority. The obligations and responsibilities detailed herein are divided into two primary domains of operation: Publisher Responsibilities for White-Label Webstore Services and Appcharge Responsibilities as Merchant of Record for Checkout Transactions.

Publisher Responsibilities for White-Label Webstore Services

Appcharge provides a white-label service enabling game publishers to operate branded online storefronts. Player login to the webstore is approved by the publisher’s system in real time, allowing the publisher to reject unapproved accounts. As a result, Appcharge does not re-verify compliance with COPPA-related terms of use, as these terms are addressed during the player’s first login to the game. Publishers are responsible for verifying user identities and ensuring compliance with regulations, including age restrictions and parental consent under COPPA, before granting access to the game application. Only players approved by the publisher can subsequently log into the webstore. Appcharge functions as an extension of the publisher’s platform, providing technical infrastructure without assuming compliance verification responsibilities.

Appcharge Responsibilities as Merchant of Record for Checkout Transactions

In its role as Merchant of Record, Appcharge oversees compliance with financial transaction standards. Appcharge’s COPPA and age policy is incorporated into the End-User License Agreement (EULA). Users affirm their age eligibility by agreeing to the EULA, which specifies that they must meet the legal age requirements. Appcharge relies on the publisher’s verification of user compliance. If a user is found to be non-compliant, Appcharge terminates their access to its services.
